One is a “your* car should be impounded permanent and your drivers license revoked” and the other is prison time.

*doesn’t matter who actually has the title; the car the was being driven.

So if I let a friend borrow my car and he does something stupid, I should lose the $50,000 machine that is absolutely critical to my employability?

That’s kinda fucked up for a loaner. I could see it on a second charge, maybe, like you loaned it once and didn’t learn your lesson so they kept it the second time. Or maaaaaaaybe if there’s a charge on them so it happens to them next time regardless, but god damn would it be shitty to lose your car because your friend just… Didn’t say anything about it before they took your car.

I mean, the list of thing you have to do to be subjected to this is not very long and easy to avoid. You wouldn’t want anyone to do this using your car, with confiscation or without, as it could just as well mean your car getting totaled in an accident:

            Violations of the Criminal Law

            • Negligent manslaughter under particularly aggravating circumstances.
            • Negligently causing significant harm to someone’s body or health under particularly aggravating circumstances.
            • Wilfully causing imminent danger to someone’s life or property.

Violations of the Road Traffic Law

            • Particularly reckless driving.

            • Speeding by more than 100 per cent when driving at a speed of more than 100 km/h.

            • Driving at a speed of 200 km/h or more.

            • Driving under the influence of alcohol with a blood alcohol level of more than 2,00.

I fully agree, I’d be furious to learn someone I’d loaned my car to did anything that would trigger the law. I just don’t think it’s fair to punish the car owner unless they had good reason to suspect it would happen. It’s potentially financially devastating to someone who just tried to help a friend with less.

I mean… Yeah. It’s really fucking stupid, if you’d like to elaborate more. The vast majority aren’t actually trying to hurt anyone and think surely they’re special enough to pull it off. That’s stupidity, not malice.
